This document regulates the terms and conditions of use of the accessed website and the commercial relationship that arises between BALNEARI PRATS, SA (hereinafter BALNEARI PRATS) and the users who make the remote contracting of the online booking services that appear on the website: www.balnearprats.com.
We ask you to read these conditions carefully before making any booking.
Making a booking and its confirmation by the User implies full acceptance of these general terms and conditions.
By making a booking on our website, you guarantee that you are over 18 years of age and that you have the necessary legal capacity to contract.

Use of booking services
Online pre-booking service:
The pre-booking services are merely informative and are intended to offer the user the possibility of checking room availability.
Within 24 hours the user will receive an email confirming whether their booking has been made, which will only be binding once accepted by BALNEARI PRATS through confirmation of the booking by email and subsequent payment by the user.
The user must verify the booking confirmation and notify BALNEARI PRATS, immediately, by email, of any error.
Online booking service:
The purpose of the booking service is to book rooms and additional services detailed on the BALNEARI PRATS, SA website.
Booking/hiring procedure:
You can navigate the website until you find the desired room, promotion or service. Once located, by clicking on it you will access all the detailed information offered by the website. From here you can add the item to your purchase.
If you are placing an order with us for the first time, you will be asked to register by entering your email address and a password with which you can create and access your account.
If you are a registered user with an active account, you must enter your email and password and the system will recognize your data.
Once you are in your account, you can continue your purchase and finally confirm the order where the total price of the order will be indicated, including VAT and the corresponding taxes.
If you do not want to make any other order, you have to press the “payment / confirmation” button to validate it.
All bookings are confirmed by paying the booking at the time it is made.
BALNEARI PRATS, can charge the amount of the booking at any time, once it has been made.
Within a maximum period of 24 hours from receipt of acceptance, you will receive confirmation of the order by email to the email address you have indicated.
In compliance with current legislation, the process generates the corresponding contract, which will be saved, and the User will have access to it at any time during the purchase process, even afterwards.
Warranty:
If the booking and payment have been made correctly, this booking is confirmed and guaranteed from that moment on.
Termination of the contract, cancellation or modification of the booking (Accommodation):
STANDARD 24H RATE
The credit card is only a means of guarantee.
Cancellation or modification of bookings by the user will not entail early cancellation fees, as long as this is made up to 24 hours before the time of arrival.
Cancellation or modification of bookings by the user outside the period established in the previous paragraph or failure to appear at BALNEARI PRATS will be charged as compensation the amount of the first night (VAT and taxes included).
To cancel or modify a booking it will be essential to send an email to info@blanearprats.com requesting the cancellation or modification.
NON REFUNDABLE RATE
BALNEARI PRATS will charge the entire amount of the stay book by the client at the time of making the booking (VAT included). For this rate, no refunds of this amount are allowed.
If BALNEARI PRATS, despite acting with due foresight and diligence, is unable to provide the contracted rooms for reasons not attributable to them and if there is an inability to provide the services under the agreed conditions, BALNEARI PRATS may:
(I) Offer the User the possibility of opting for a full refund of the amount paid.
(II) Offer the User its replacement with another one with characteristics and specifications similar to or superior to the one initially requested, provided that these agree with the User's needs.
(III) Offer the User, if the replacement service results in a lower category or quality, a refund of the difference.
Information on the exercise of the right of withdrawal:
According to article 103.L) of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of consumers and users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16 -EDL 2014/35453-, Spanish legislation is adapted to the provisions of Directive 2011/83/EU, of October 25, on consumer rights, which repeals Directives 85/577 / CEE and 97/7 -EDL 2011 / 260927-, the right of withdrawal will not be applicable to contracts that refer to:
The provision of accommodation services for purposes other than housing, transportation of goods, vehicle rental, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.
Prices
Prices will only be valid in writing and for the period indicated.
The price of each booking will be indicated to you during the booking process. In accordance with current legislation, all purchases made from our website will be subject to value added tax. The applicable rate will be the one legally in force at all times.
Prices may change at any time. However, possible changes will not affect the bookings of those for whom BALNEARI PRATS has already sent the Booking Confirmation.
Accepted payment methods
For the Standard 24h rate, payment for the booking can be made at the establishment (credit card details for guarantee).
-By credit or debit card
The amount of the order will be charged to the card, so you must indicate the number, the expiration date as well as the security code CW2 (included on the front). If the card is secured, you will be asked for the relevant security codes.
These data will not be saved or manipulated by us, but will be registered directly in the payment gateway of the corresponding financial institution. For greater security, we will use an Electronic Commerce authentication service
Secure, system established by Visa / Mastercard / Eurocard, by which the user is authenticated before their issuing entity and the merchant is authenticated before their acquiring bank.
In order to guarantee the confidentiality and integrity of transactions, these are carried out through the SSL (Secura Socket Layer) protocol with 256-bit security keys.
The charge will be carried out in real time through this payment gateway. In the event that the charge cannot be carried out finally (for any reason), the order will be automatically cancelled.

Conflict resolution
Spanish legislation will apply to this contract. The parties agree to submit to the Courts and Tribunals of Santa Coloma de Farners for the resolution of any controversy, conflict or claim arising from this contract, expressly waiving any other jurisdiction that may apply to them.
Modification of the conditions of sale
We reserve the right to make changes to our website, our policies and our terms and conditions, including these General Conditions, at any time.
You will be subject to the terms and conditions, policies and General Conditions in force at the time the booking is made, unless, by law or at the request of public authorities, a change is made to these terms and conditions, policies or of the General conditions.
If any of these conditions is declared invalid, void or for any reason ineffective, this condition will be deemed to be excluded without this declaration affecting the validity or enforceability of the rest of the conditions.
Partial nullity
In the event that any clause of these General Conditions is declared void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these General Conditions.
The non-exercise by BALNEARI PRATS of any right derived from these General Conditions will not be interpreted as a waiver of this right, unless expressly waived in writing by BALNEARI PRATS or prescription of the action that corresponds in each case.
